These Terms of Service ("Terms") govern your use of the Evinco Vitals website and services, provided by Evinco Industries (Pty) Ltd, 2024/862354/07 ("Evinco Vitals", "we", "us"). By booking a consultation or purchasing a pillar service, you agree to these Terms.
Evinco Vitals provides a business health consultation and assessment service for South African SMEs, structured across four pillars: Financial Compliance, Marketing, HR Compliance, and Cyber Security. The consultation produces a business health score. You may then purchase one or more pillar services separately to address gaps identified.
The health score is a point-in-time assessment based on the information and documents you provide and, where applicable, data you upload. It is our professional assessment and does not constitute a guarantee of funding, credit approval, investment, or any other financial outcome.
Pillar services may be delivered directly by Evinco Vitals or by an associate operating under the Evinco Vitals brand. In all cases, Evinco Vitals remains your point of contact, invoices you directly for the service, and remains responsible for the quality and confidentiality of the work delivered.
Evinco Vitals helps you understand and improve your business's compliance and operational health. We do not guarantee that achieving any particular score will result in loan approval, investment, grant funding, or any other financial outcome, as these decisions are made by third parties applying their own criteria.
We treat the information and documents you provide as confidential and will only share them with associates or service providers to the extent necessary to deliver the services you have requested, as described in our Privacy & Data Protection Policy.
The Evinco Vitals scoring methodology, reports, branding, and website content are the intellectual property of Evinco Vitals / Evinco Industries (Pty) Ltd. You may use reports generated for your business for your own internal and funding-related purposes, but may not resell, redistribute, or represent our methodology as your own.
To the maximum extent permitted by law, Evinco Vitals' liability for any claim arising from these Terms or our services is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect or consequential loss, including loss of funding opportunities, business interruption, or loss of profit.
Either party may terminate an engagement for a specific pillar service with reasonable written notice. Fees for work already performed remain payable. We may decline or discontinue service where information provided is inaccurate, or where we reasonably believe continuing would expose either party to legal or reputational risk.
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of the South African courts.
We may update these Terms from time to time. Continued use of our services after an update constitutes acceptance of the revised Terms.
